Privacy Policy

1. Introduction and Scope

1. 1.1This Privacy Policy (the "Policy") describes how untz LLC, a Delaware limited liability company ("untz," "we," "us," or "our") collects, uses, discloses, and retains information in connection with the untz mobile application, the website located at untz.co, and any related services (collectively, the "Service").
2. 1.2This Policy is a statement of our information practices. It does not form part of any contract between you and untz. Your access to and use of the Service are governed by our Terms of Service, available at untz.co/terms (the "Terms").

2. Eligibility and Geographic Scope

1. 2.1The Service is intended solely for individuals who are at least eighteen (18) years of age. Users confirm that they meet this requirement when they first sign in. We do not knowingly collect personal information from any individual under eighteen. If we become aware that an account is held by an individual under eighteen, we will delete the account and the information associated with it. Reports of such accounts may be sent to support@untz.co.
2. 2.2The Service is offered in the United States. If you access the Service from outside the United States, you acknowledge that your information will be transferred to, stored in, and processed in the United States in accordance with this Policy.

3. Information We Collect

1. 3.1We collect information (a) that you provide to us directly, (b) that is generated through your use of the Service, and (c) that is recorded automatically by our systems. The categories of information we collect, and their sources, are set out in the following table.

1. 3.2Information we do not collect. We do not collect: (a) precise geolocation data; the application does not request location permission, and any reading of a photograph's location metadata to suggest a venue occurs on your device only; (b) your contacts; the application does not access your address book; (c) the contents of your photo library beyond the items you select; where you save media from the Service to your device, the application requests write-only access and cannot read your library; (d) audio, other than during a recording you initiate with the grab feature, which you may cancel; or (e) information about your activity on other applications or websites; we do not track users across third-party applications or websites, and the application does not use Apple's App Tracking Transparency framework.
2. 3.3Website. The untz.co website does not use analytics services and does not set cookies, other than a session cookie used for administrative access by untz.

4. Audio Recordings

1. 4.1The grab feature records approximately twenty (20) seconds of audio through the device microphone, upon your affirmative action, for the purpose of identifying music being played.
2. 4.2Each recording is transmitted to and stored on our servers in association with the relevant night, whether or not the music is identified, so that other participants in that night may play the recording and assist in its identification.
3. 4.3Recordings are accessible to all participants in the relevant night and may capture voices and other ambient sound in your vicinity.
4. 4.4Recordings are retained for as long as the associated night exists. A recording is deleted when the night is deleted, when you remove the recording, or when you delete your account.
5. 4.5For identification purposes, a signature derived from the audio, rather than the recording itself, is transmitted to a third-party music recognition service.
6. 4.6We do not use recordings to identify individuals, do not generate voiceprints or other biometric identifiers, and do not apply facial recognition technology to photographs.
7. 4.7The application presents the foregoing information and requests your confirmation before your first use of the grab feature. You may cancel a recording in progress and may disable microphone access at any time through your device settings. Laws governing audio recording vary by jurisdiction; your responsibilities in that regard are set out in the Terms.

5. Use of Information

We use the information described in Section 3 for the following purposes:

1. to operate the Service, including maintaining your account, displaying your nights and rankings, delivering your content to the users with whom you share it, and identifying music in your recordings;
2. to connect you with other users, including establishing friend connections arising from shared nights, delivering invitations and requests, and giving effect to blocks;
3. to deliver notifications that you have enabled;
4. to analyze usage information and content, including nights, ratings, and notes, in order to understand, maintain, and improve the Service and to develop new features;
5. to protect the security and integrity of the Service, including detecting abuse, enforcing rate limits, diagnosing errors, and preventing unauthorized access; and
6. to respond to your inquiries, to enforce the Terms, and to comply with applicable law.

6. Disclosure of Information

1. 6.1To other users. The Service is designed for sharing. The following information is visible to other persons in accordance with settings and actions under your control:
   1. Participants in a night may view all information associated with that night, including the identities of participants, each participant's rating and notes once that participant has rated the night, and every photograph, video, song, and recording added to it.
   2. Your friends, meaning users with whom you have shared a night or whom you have added and who have accepted, may view your ranked nights and open the nights in which you participated.
   3. Any person who receives an invitation link that you or another participant shares may view the night's summary information (artist, venue, date, artwork, and number of participants) and, by joining, becomes a participant in that night.
   4. Your display name and profile photograph are visible to other users with whom you interact, may be located by users searching by name, and are displayed to any person who opens a friend link that you share, whether or not that person has installed the application.
   5. Blocking a user conceals each of you from the other throughout the Service and prevents new connections between you. It does not remove the record that you both participated in a night that has already occurred.
2. 6.2Media storage. Photographs, videos, and recordings are stored at addresses that are not practicably guessable but are not subject to access controls. Any person in possession of a file's address may access that file. Sharing a link is equivalent to sharing the content itself.
3. 6.3Access by untz. We may access content stored on the Service, including notes, where necessary to operate the Service, respond to reports, diagnose problems, or enforce the Terms. We do not otherwise review content.
4. 6.4Service providers. We engage third-party service providers to host the Service, store the database and media files, deliver notifications, monitor errors, and provide email services. These providers process information on our behalf, under contractual terms that restrict their use of the information to the services provided to us and require them to provide the same or equal protection of user information as is set out in this Policy. Apple provides sign-in and notification delivery services. When you use music features, a signature derived from your recording, or your search query, is transmitted to third-party music recognition, music catalog, and event listing services in order to identify or locate the requested content; where such requests are transmitted from our servers, they are not associated with your identity.
5. 6.5Legal requirements and protection of rights. We may disclose information where we believe in good faith that disclosure is necessary to comply with a legal obligation, court order, or lawful request of a governmental authority; to enforce the Terms; or to protect the rights, property, or safety of untz, our users, or the public.
6. 6.6Business transfers. If untz is involved in a merger, acquisition, financing, reorganization, or sale of all or a portion of its assets, information may be transferred as part of that transaction. This Policy will continue to apply to the transferred information until it is amended in accordance with Section 11.
7. 6.7With your consent. We disclose information for any other purpose only at your direction or with your consent.

7. Advertising, Analytics, Partnerships, and Sale of Personal Information

1. 7.1Current practices. The Service does not display advertising. We do not sell personal information and do not share personal information for cross-context behavioral advertising. The only analytics we conduct are our own, as described in Sections 3 and 5.
2. 7.2Reserved practices. We may in the future: (a) display advertising within the Service, including advertising selected on the basis of your activity within the Service; (b) provide statistics regarding attendance and ratings to venues, promoters, artists, or other partners in aggregated or de-identified form that does not identify you; (c) engage ticketing or affiliate partners, who may learn that you navigated to their services from the Service; and (d) integrate third-party analytics or attribution services.
3. 7.3Commitments. Before implementing any practice described in Section 7.2, we will amend this Policy, provide notice within the application, and, where required by applicable law, obtain your consent or provide you with a means to opt out. We will not attempt to re-identify aggregated or de-identified information, and we will contractually prohibit recipients of such information from doing so.
4. 7.4Do Not Track and Global Privacy Control. The Service does not respond to browser "Do Not Track" signals or Global Privacy Control signals, because we do not track users across third-party websites or applications and do not sell or share personal information. No third party collects information regarding your activity across other websites or applications through the Service. Should we begin selling or sharing personal information, we will honor Global Privacy Control signals as required by applicable law.

8. Retention of Information

1. 8.1Account information and content are retained for as long as your account exists. Content associated with a night is retained for as long as that night exists for any participant.
2. 8.2Upon deletion of your account through the application's settings, your account information, ratings, notes, photographs, videos, recordings, friend connections, notification tokens, and usage information are deleted without undue delay. Songs you added to a night remain associated with that night without attribution to you. Nights you shared with other users continue to exist for those users without your participation.
3. 8.3When you remove a photograph, video, recording, or night through the application, it is deleted from storage promptly.
4. 8.4Server logs are retained for a limited period. Error reports are retained for up to ninety (90) days. Database backups are retained for no more than thirty (30) days following a deletion.
5. 8.5The invitation-matching hash described in Section 3.1 is used for forty-five (45) minutes and is deleted from our records within one (1) day.
6. 8.6Correspondence is retained for as long as necessary to address your inquiry and for our records.
7. 8.7We may retain information for longer periods where required by applicable law or where reasonably necessary to resolve disputes or enforce the Terms.

9. Your Rights and Choices

1. 9.1All users. You may: (a) view and edit your display name, profile photograph, nights, ratings, and content within the application; (b) delete your account through Settings, which takes effect immediately and cannot be reversed; (c) disable notifications and microphone access at any time through your device settings; and (d) request a copy of your information, a correction, or the deletion of specific information by contacting support@untz.co. We will verify that a request originates from the account holder before acting on it and will respond within thirty (30) days, or within any shorter period required by applicable law.
2. 9.2Individuals who are not users. A user may add your name to a night, or you may appear in a photograph or recording. If you are not a user and wish to have content concerning you removed, contact support@untz.co. We will remove the content or explain why we are unable to do so.
3. 9.3California residents. California law grants residents the right to know the categories of personal information collected, used, and disclosed; the right to correct or delete personal information; the right to opt out of the sale or sharing of personal information; and the right not to be subject to discriminatory treatment for exercising these rights. We do not sell personal information or share it for cross-context behavioral advertising, and we do not use or disclose sensitive personal information for purposes other than providing the Service. Should these practices change, we will provide a "Do Not Sell or Share My Personal Information" mechanism and honor Global Privacy Control signals. You may designate an authorized agent to submit a request on your behalf; we will require proof of the agent's authorization. Requests may be submitted to support@untz.co.
4. 9.4Residents of other states. If the state in which you reside grants you privacy rights, you may exercise them by the same means, and you may appeal any decision by replying to our response. We extend these rights to all users regardless of residence.

10. Data Location and Security

1. 10.1Your information is stored and processed in the United States.
2. 10.2Information is transmitted between your device and our servers over encrypted connections. Access to our systems is limited to personnel and service providers with a need for such access. Sessions are protected by credentials that are not practicably guessable, and links to nights and media use addresses that are not practicably guessable.
3. 10.3No system is entirely secure, and we cannot guarantee that unauthorized access will never occur. If we become aware of a security breach affecting your information, we will notify you and the relevant authorities as required by applicable law.

11. Changes to This Policy

1. 11.1We may amend this Policy from time to time to reflect changes in our practices. The Effective Date above indicates when this Policy was last revised, and prior versions remain available at the address stated above.
2. 11.2In the case of material changes, including the implementation of any practice described in Section 7.2, we will provide notice within the application before the change takes effect.
3. 11.3We will not use information collected under a prior version of this Policy in a manner materially different from that disclosed at the time of collection without your consent.
